1. All prices quoted are ex works & ex VAT

2. Invoices must be paid net within 30 days after the invoice date; unless expressly agreed otherwise in writing between Hacotec Oss BV and the client. If deferment of payment or bankruptcy has been requested for the client, the claims of Hacotec Oss BV become immediately due and payable
Invoices were innerhalb 30 Tagen nach dem Fakturdatum bezahlt, net; außer explizit schriftlich else vereinbart zwischen Hacoetec Oss BV und den Auftraggeber. Im Falle von Anfrage von Zahlungsaufschub oder Bankrott, sind die Ansprüche von Hacotec Oss BV direkt forderbar
Invoices have to be paid within 30 days after date of invoice, net; unless otherwise agreed between Hacotec Oss BV and the principal in an explicitly written statement. In case of filing postponement of payment or bankruptcy of the principal/buyer, the claims of Hacetec Oss BV will be immediately effective

3. Hacotec Oss BV reserves the right to make interim changes to the collection and price

5. First deliveries to new customers are against payment in advance

First deliveries to new clients are to be pre-paid

6. Collection or transport of the goods takes place in consultation with the client
Abholung oder Transport der Waren wird übereingekommen zwischen Hacotec Oss BV und der Auftraggeber
Mode of forwarding will be agreed upon by Hacotec Oss BV and the principal

7. Sample samples serve as an example for the delivered goods; delivered goods may deviate from this, unless expressly agreed otherwise
Vorbild-Muster sind ein Vorbild für die gelieferte Waren; die gelieferte Waren können abweichen, außer ausdrücklich else übereingekommen
Samples are shown or issued as a guidance for the appearance of the delivered goods; features of the delivered goods may differ from the sample, unless otherwise explicitly agreed

8. Hacotec Oss BV guarantees that the delivered goods are free of defects - with regard to design, material and manufacturing - for a period of three months from the date of delivery.
Warranty expires if the defects are caused by misuse
Hacotec Oss BV guarantees that those sweet goods are fehlerfrei sind – in Design, Material und Herstellung - für drei Monaten nach Lieferung. That Guarantee loses ihre Wirkung bei falscher Anwendung der Waren
Hacotec Oss BV guarantees that the delivered goods are free of defects – in design, material and manufacture - for a period of three months after the delivery. The guarantee does not apply if the damage is caused by incorrect treatment

9. Hacotec Oss BV is not liable for damage and costs that arise directly or indirectly from defects in the goods delivered by Hacotec Oss BV.

Hacotec Oss BV is not liable for damage or costs as a direct or indirect result of defects in the goods supplied by Hacotec Oss BV

10. The buyer/client must inspect the delivered goods for:
Grade name/number, color, size, quantity, grade
Shortcomings must be reported to Hacotec Oss BV within 8 days after delivery. Claims of Hacotec Oss BV against the buyer/client from previous orders cannot be suspended in the event of an established shortcoming
Der Kaufer/Auftraggeber soll prüfen ob die gelieferte Waren übereinstimmen mit der orderten Qualität: Qualitätsname/-Nummer, Farbe, Maß, Zahl, Qualität
Mängel sollen innerhalb 8 Tagen nach Lieferung were reported at Hacotec Oss BV. Ansprüche von Hacotec Oss BV auf den Kaufer/Auftraggeber aus früheren Aufträge, were nicht verschoben im Falle von einem konstatierten Mangel

11. Force Majeure. Hacotec Oss BV is released from its obligations under the supply agreement if fulfillment thereof is prevented or delayed by force majeure, which includes: storm damage, strikes, terrorist threats, etc.
superpower. Hacotec Oss BV ist befreit von seinem Pfheden laut Lieferbedingungen im Falle von Umstände verursacht durch Übermacht. Darunter wird verstehen: Sturmschaden, Streich, Terrordrohen, unz.
Force major. Hacotec Oss BV is freed of its obligations to deliver as agreed, in case of circumstances that are caused by force majeur. Under which is understood: storm damage, strike, threat of terror, etc.

12. If Hacotec Oss BV is held liable by a third party, the amount that may result from this will be limited by the amount of the present order to be performed by Hacotec Oss BV.
In case of liability of Hacotec Oss BV by a third party, the amount of the liability is limited by the amount stated in the order given to Hacotec Oss BV on which the claim of liability is based.
Im Falle von Haftung von Hacotec Oss BV, wird den Anspruch limitiert durch die Höhe des Betrages aus dem zugrunde liegenden Vertrag.

13. The purchase or assignment agreement between Hacotec Oss BV and the buyer/client falls under the scope of Dutch law; to the exclusion of any other right
Die Vereinbarung zum Kauf oder zur Lieferung zwischen Hacotec Oss BV und der Kaüfer/Auftragsgeber wird ausschliesend durch ein Niederländisches Gericht
The agreement of sales & delivery between Hacotec Oss BV and the buyer/principal will be governed by Dutch law, and by Dutch law alone
